Grievance Procedures
Complaints concerning sexual, racial, disability or other harassments are filed and addressed according to established policies and procedures. Any student who alleges a policy violation must file a Grievance Report with the appropriate Compliance Coordinator within thirty (30) working days following the alleged incident. If the grievance involves the Compliance Coordinator, the Grievance Report may be filed with the Career Assessment and Learning Director.
Upon notification of a grievance, the Compliance Coordinator will instruct the grievant (defined as the person fling the grievance) on completing the Grievance Report form. The written report should contain a description of the alleged violation, the respondent (defined as the person against whom the grievance is being filed) involved, and the action requested. If an oral report is preferred by the grievant, the Compliance Coordinator, unless the grievance involves the Coordinator, will prepare a written record of the grievance and ask the grievant to sign the statement.
Generally, within forty-five (45) working days, following the filing of the grievance, the Compliance Coordinator will conduct an investigation. This investigation may include a review of any and all documentation involved in the grievance, interviews and/or sworn statements from all individuals involved. The Compliance Coordinator will review the evidence gathered during the investigation and compile a written report. Using the Grievance Investigation Report form, the Compliance Coordinator will present findings of fact, conclusions of law, and recommendations as to corrective, remedial, or disciplinary action to be taken, if necessary.
The Grievance Investigation Report will be submitted to the Executive Vice President of the college to evaluate all evidence and make a decision regarding resolution of the grievance. A written decision will be provided by the Executive Vice President and copies given to the grievant and respondent. The decision will include a statement of the right to appeal to the President of the college as well as the procedures involved. The Executive Vice President shall have thirty (30) working days from the receipt of the Grievance Report to render a decision. The thirty (30) days may be extended in certain circumstances.
An appeal of the Executive Vice President's decision must be submitted to the President in writing and include the reasons for the appeal and state what action is requested. The appeal to the President must be submitted within fifteen (15) working days after receipt of the decision from the Executive Vice President. The President will issue a final decision.
